Welcome to Goblin Loot Liquidators. By accessing, browsing, and making purchases on our website, associated sales platforms, or directly at our physical facilities (collectively, the “Site” or the “Company”), you (the “Buyer”, “User”, or “Reseller”) irrevocably agree to be bound by the following General Terms and Conditions of Sale.

Please read them carefully. This is a legally binding contract. Because we operate in the B2B (Business-to-Business) wholesale and liquidation sector, standard consumer protection laws that apply to the purchase of new retail products do not fully apply to these transactions. By doing business with us, you assume the inherent risks of the commercial liquidation industry (Caveat Emptor or “Buyer Beware”).

1. NATURE OF INVENTORY (Liquidation, Returns, and Mystery Boxes)

You explicitly understand and accept the volatile and variable nature of the liquidation business. The merchandise sold by Goblin Loot Liquidators does not come directly from the manufacturer in pristine condition. It consists of customer returns, overstock, shelf pulls, open-box items, distressed packaging products, and salvage merchandise sourced from major retailers and fulfillment centers.

  • Mystery Boxes and Blind Lots: The specific content, brands, sizes, and exact categories of the items are unknown until opened. While we guarantee a target MSRP (Manufacturer’s Suggested Retail Price) based on the purchased tier (Silver, Gold, Platinum), we absolutely do not guarantee the inclusion of specific items, colorways, electronic compatibility, or the viability of the items for personal use. Receiving duplicate items within the same lot is possible.
  • Merchandise Condition and “AS-IS” Status: Unless a manifest explicitly states a lot is “Factory New,” all inventory is sold strictly in “AS-IS” condition, with no warranties of any kind, express or implied. Items may exhibit:
    • Severe wear on the original packaging or be shipped in generic brown boxes.
    • Minor dents, scratches, or cosmetic damage that do not impair functionality.
    • Prior shipping labels, permanent marker defacements, or clearance stickers.
    • Missing instruction manuals, power cords, batteries, screws, or minor components.
    • Warranty codes, software, or digital content that have already been redeemed or expired.
    • Any other unlisted defect or missing part inherent to returned, salvage, or open-box merchandise.

2. RETURNS, REFUNDS, AND CHARGEBACK POLICY

We operate on extremely tight profit margins to provide you with inventory below traditional wholesale costs. Therefore, our financial policy is absolute and strictly non-negotiable:

  • ALL SALES ARE FINAL: There are no returns, exchanges, store credits, or refunds. We do not accept returns for “buyer’s remorse,” miscalculations in your sourcing budget, inability to resell the merchandise, or because the specific items in a Mystery Box did not meet your personal expectations.
  • Chargeback Prohibition: By accepting these terms, you waive your right to file chargeback disputes through your bank, PayPal, or credit card provider on the grounds of “item not as described,” given that the “AS-IS” condition is clearly established. Any attempt at a fraudulent chargeback will result in the permanent suspension of your account, your inclusion in industry-wide liquidator blacklists, and potential legal action to recover funds, including attorney’s fees and the immediate referral of the debt to third-party collection agencies.
  • Exceptions and Claim Protocol: The sole exception to our final sale policy will be granted in the event of a severe logistical error on our part (e.g., shipping a “Silver Box” when you paid for a “Platinum Box”, or a pallet missing more than 30% of the manifested volume). Any claim must follow this strict protocol:
    1. Written notification to our official dispute email (e.g., support@yourdomain.com) within 48 hours of signing for the receipt of the merchandise.
    2. The claim must be accompanied by a continuous, unedited unboxing video. The video must start by clearly showing the original, untampered shipping label on the sealed box, the opening process, and the removal of all contents. Static photographs or edited videos will not be accepted as proof of missing items.

3. MSRP CALCULATION AND RESALE VIABILITY

For products and boxes where we guarantee an MSRP value, this value is calculated using UPC barcode databases and the original list price of the item on major retail platforms (e.g., Amazon, Target, Walmart) at the exact time the item was processed and scanned at our Miami, FL facility.

  • Price Fluctuation: We recognize that retail prices fluctuate daily due to markdowns, seasonal events (Black Friday), and brand-direct liquidations. We do not retroactively adjust the MSRP if the market value drops after our initial scan.
  • No Guarantee of Profitability: We do not guarantee, promise, or imply that you will be able to resell the items at the exact MSRP, nor that you will achieve a specific profit margin. The actual resale value on the secondary market (eBay, Facebook Marketplace, Poshmark, flea markets) depends entirely on your business acumen, platform choice, and market demand.
  • Third-Party Platform Restrictions (“Gated Brands”): Goblin Loot Liquidators does not guarantee that you are authorized to resell certain trademarked brands on platforms like Amazon (Brand Gating). We provide liquidation receipts, but we do not provide direct manufacturer invoices to unlock restricted categories (ungating). Verifying selling restrictions is the sole responsibility of the Buyer.

4. SHIPPING, PALLET LOGISTICS, AND LOCAL PICKUP POLICIES

  • Domestic Shipping and LTL Freight: Shipping transit times provided at checkout are estimates and are not guaranteed. Risk of loss, damage, and legal title to the items transfer to you the moment we hand the merchandise over to the carrier (FOB Origin).
    • For pallet shipments, the Buyer is responsible for providing adequate truck access. If the delivery location is residential or requires a liftgate, and this was not notified and paid for in the original order, the freight carrier will charge additional fees, which are the sole responsibility of the Buyer.
  • Transit Damage: We are not liable for crushed boxes, tipped pallets, porch piracy, or damage caused by the mishandling of courier companies (UPS, FedEx, USPS, or LTL carriers). Any claim for transit damage must be filed directly by the Buyer with the respective shipping carrier.
  • Local Pickup (Miami, FL) and Merchandise Abandonment: If you select the local pickup option at our warehouse, you must present a valid government-issued ID and the physical credit card that matches the order information.
    • You must retrieve the merchandise within 5 business days following the “Ready for Pickup” notification.
    • Orders not picked up after 5 days will be subject to a daily storage fee of $20 USD.
    • Abandonment: If the order is not picked up within 14 calendar days following the initial notification, the merchandise will be deemed legally abandoned. Goblin Loot Liquidators will retain all funds paid and reserves the right to dispose of or resell the inventory as it sees fit. The Buyer forfeits any right to partial or full refunds, overages, or claims regarding said order.

5. LIMITATION OF LIABILITY AND INDEMNIFICATION

  • Liability Cap: To the maximum extent permitted by Florida state law, the total cumulative liability of Goblin Loot Liquidators, its directors, employees, or affiliates, for any claim arising from the use of our website or the purchased merchandise (whether in contract, tort, negligence, or otherwise), shall never exceed the exact purchase price paid for that specific lot or product.
  • Exclusion of Consequential Damages: Under no circumstances shall we be liable for indirect, special, punitive, incidental, or consequential damages. This includes, without limitation, loss of profits, loss of business, business interruption, loss of reputation, or suspension of your seller accounts on third-party platforms.
  • Civil Liability and Bodily Injury: Due to the nature of returned and open-box products, we cannot verify the structural, safety, or electrical integrity of every item. By purchasing liquidation merchandise, you agree to indemnify and hold Goblin Loot Liquidators harmless from any claim, bodily injury, personal injury, or property damage (e.g., fires caused by defective electronics) arising from the use, resale, or handling of the purchased merchandise.
  • Force Majeure: We shall not be held liable for any breach or delay in our obligations caused by events beyond our reasonable control, including but not limited to: natural disasters (hurricanes, floods), pandemics, logistical strikes, supply chain failures, or governmental actions.

6. GOVERNING LAW, DISPUTE RESOLUTION, AND WAIVERS

  • Jurisdiction: These Terms and Conditions, as well as any commercial transaction conducted with us, shall be governed by and construed exclusively in accordance with the laws of the State of Florida, United States, without giving effect to any principles of conflicts of law.
  • Dispute Resolution: Any dispute or claim arising out of or relating to these purchases shall be settled by confidential Binding Arbitration administered by the American Arbitration Association (AAA) in Miami-Dade County, Florida, rather than in court. The Buyer agrees to submit to the personal jurisdiction of such venues and waives any objection of inconvenient forum.
  • Class Action Waiver: By accepting these terms, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

7. MODIFICATIONS AND SEVERABILITY

  • Changes to Terms: We reserve the absolute right to update, modify, or replace these Terms and Conditions at any time by posting updates to this page. It is the Buyer’s responsibility to review this policy periodically prior to making a new purchase. Continued use of the Site or the placement of new orders following the posting of changes constitutes tacit acceptance of those modifications.
  • Severability: If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from the rest of this agreement and shall not affect the validity and enforceability of any remaining provisions.

By using our website, completing a transaction at our physical facilities, or by checking the mandatory acceptance box (“I Accept the Terms and Conditions”) during digital registration or checkout, you digitally sign this document and confirm that you have read, understood, assessed the risks, and accepted this binding agreement in its entirety.
